Pesticide Containment and Containment Pad Determination
The U.S. EPA regulations require secondary containment units where bulk pesticides are stored and containment pads where bulk pesticides are transferred by August 16, 2009. The specific regulations are in the Code of Federal Regulations Title 40 Subpart E—Standards for Pesticide Containment Structures. This includes 40 CFR 165.80 through 165.97. The EPA Container & Containment Rule includes secondary containment, load pads, shut-off valves, inspection documentation, and more.
The Oklahoma Department of Agriculture, Food and Forestry (ODAFF) adopted these regulations by reference in the Combined Pesticide Law and Rules (35:30-17-89.1). ODAFF has put together the following questionnair to determine your need for secondary bulk pesticide containment or containment pad for your operation or business. Please use both columns of the quesionnair to determine if you meet the requirements.

Pesticide Secondary Containment Determination
Exempt Containers:
  1. Empty Containers
  2. Containers holding rinsate or wash water and so labeled.
  3. Containers holding gaseous pesticides at normal atmospheric pressure.
  4. Containers dedicated to non-pesticide use and so labeled.

1.  Are you a pesticide refilling establishment whose principal business is retail sales?
2.  Are you a Commercial Pesticide Applicator?

Pesticide Containment Pad Determination
Exempt from Containment pad if you:
  1. Only have gaseous pesticides
  2. Containers holding rinsate or wash water and so labeled.
  3. Containers holding gaseous pesticides at normal atmospheric pressure.
  4. Containers dedicated to non-pesticide use and so labeled.
